TERMS OF USE
BY USING THIS JACKSONS LET’S GO REWARDS WEB AND MOBILE APPLICATION ("THE "APPLICATION"), YOU (THE "USER") ACCEPT THESE TERMS AND CONDITIONS ("TERMS"). THESE TERMS CONSTITUTE A BINDING AGREEMENT, GOVERNING USE OF THE APPLICATION, BETWEEN USER AND JACKSONS FOOD STORES, INCLUDING ITS SUBSIDIARY, RELATED, AND AFFILIATED COMPANIES. BY DOWNLOADING, INSTALLING, OR USING THE APPLICATION, USER ACKNOWLEDGES AND AGREES TO BE BOUND BY THESE TERMS. SHOULD USER NOT ACKNOWLEDGE AND AGREE TO THESE TERMS, USER MUST IMMEDIATELY UNINSTALL THIS APPLICATION AND DISCONTINUE ITS USE. THESE TERMS ARE ALSO AVAILABLE ON THE JACKSONS FOOD STORES WEBSITE ( HTTPS://JACKSONS.COM ) AND IN THE APPLICATION'S TERMS SCREEN. CONTINUED USE OF THE APPLICATION SIGNIFIES YOUR CONTINUED ACCEPTANCE OF THESE TERMS AND ANY CHANGES TO THEM.
Age Restriction
Only individuals thirteen (13) years of age or older may use the Application. Users between the ages of thirteen (13) and eighteen (18) must review these Terms with a parent or legal guardian to ensure the parent or legal guardian acknowledges and agrees to these Terms. Should User's parent or legal guardian not acknowledge and agree to these Terms, User must immediately uninstall this Application and discontinue its use.
Incorporation of Related Terms
These Terms incorporate and supplement the Apple, Inc. ("Apple") and incorporate and supplement Google ("Android) Terms and Conditions (available at http://www.apple.com/legal/itunes/us/terms.html#service ) and Android Terms and Conditions (available at https://www.android.com/enterprise/terms/ ) including without limitation the Licensed Application End User Agreement therein ("Apple Terms" and "Google Terms"). These Terms also incorporate, and supplement other terms, conditions, and policies of Jacksons Food Stores posted at https://jacksons.com/terms , including without limitation the following related terms, conditions, and other policies, the location, and terms of which may be changed from time-to-time.

End-User License
Subject to these Terms, Jacksons Let’s Go Rewards, grants the User a personal, non-exclusive, non-transferable, limited, and revocable license to use the Application for personal use only on an Android Phone, Android Tablet ("Android Device"), Apple iPhone, iPad, or iPod Touch ("iOS Device") owned or controlled by User as permitted by the Usage Rules contained in the Apple and Google Play Terms and accordance with these Terms ("User License"). Any use of the Application in any other manner, including, without limitation, resale, transfer, modification, or distribution of the Application or text, pictures, music, barcodes, video, data, hyperlinks, displays, and other content associated with the Application ("Content") is prohibited. This Agreement and User License also govern any updates to, or supplements or replacements for, this Application unless separate terms accompany such updates, supplements, or replacements, in which case the separate terms will apply.
JACKSONS LET'S GO REWARDS Virtual Card Feature
By using the Application's Virtual Card features, the User agrees to the Jacksons Let’s Go Rewards Card Terms and Conditions, Terms of Use and Privacy Policy (available at https://jacksons.com) JACKSONS FOOD STORES reserves the right to change such terms and conditions and privacy policy, and/or discontinue the Application's JACKSONS LET'S GO REWARDS features at any time and without notice to User.
User Information
By using the Application's Virtual Card features, the User agrees to the Jacksons Let’s Go Rewards Card Terms and Conditions, Terms of Use and Privacy Policy (available at https://jacksons.com) JACKSONS FOOD STORES reserves the right to change such terms and conditions and privacy policy, and/or discontinue the Application's JACKSONS LET'S GO REWARDS features at any time and without notice to User.
Prohibited Uses
Use of the Application is limited to the contemplated functionality. The Application shall not be used in any way that,
- Harasses, abuses, stalks, threatens, defames, or otherwise infringes or violates the rights of any other party (including but not limited to rights of publicity or other proprietary rights);
- is unlawful, fraudulent, or deceptive;
- uses technology or other means to access unauthorized content or non-public spaces;
- uses or launches any automated system or process, including without limitation, "bots," "spiders," or "crawlers," to access unauthorized content or non-public spaces;
- attempts to introduce viruses or any other harmful computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
- attempts to damage, disable, overburden, or impair Jacksons Food Stores servers or networks;
- attempts to gain unauthorized access to a Jacksons Food Stores computer network;
- attempts to gain unauthorized access to Jacksons Food Stores user accounts;
- encourages conduct that would constitute a criminal offense, or that gives rise to civil liability;
- violates these Terms in any manner; or;
- fails to comply with applicable third-party terms and conditions or other third-party policies (collectively "Acceptable Use").
User-Generated Content
The User may generate content, written or otherwise, while using the Application ("User-Generated Content"). User acknowledges and agrees that User-Generated Content may be used, reproduced, displayed, modified, deleted, added to, adapted, and published by Jacksons Food Stores (i.e., in product marketing campaigns). User grants Jacksons Food Stores and its successors a worldwide; irrevocable; transferable; sublicensable; fully-paid and royalty-free; non-exclusive license to use, reproduce, display, modify, delete from, add to, adapt, publish, and prepare derivative works from the User-Generated Information. User further acknowledges and agrees that the User, and the User alone, is responsible for the development of User-Generated Content.
Indemnification
User agrees to indemnify and hold harmless Jacksons Food Stores, including its agents, affiliated companies, employees, contractors, directors, and officers, and anyone involved in creating or providing the Application, from all claims or causes of action, liabilities, damages, costs, fines, penalties, and expenses (including attorneys' fees) occurring from or related to the use or misuse of the Application, violation of these Terms, or violations of any rights of a third party, or any allegation thereof. Jacksons Food Stores reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by the User, in which event the User will cooperate in asserting any available defenses.
No Warranties
JACKSONS FOOD STORES IS PROVIDING THE APPLICATION AND CONTENT TO THE USER "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OR REPRESENTATIONS, EXPRESSED OR IMPLIED. THE USER IS USING THE APPLICATION AT HIS OR HER OWN RISK. TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, JACKSONS FOOD STORES DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES THAT THE APPLICATION IS MERCHANTABLE, RELIABLE, ACCURATE, FIT FOR A PARTICULAR PURPOSE OR NEED, NON-INFRINGING OR FREE OF DEFECTS OR ABLE TO OPERATE ON AN UNINTERRUPTED BASIS, OR THAT THE USE OF THE APPLICATION BY THE USER IS IN COMPLIANCE WITH LAWS, OR THAT USER INFORMATION TRANSMITTED IN CONNECTION WITH THE APPLICATION WILL BE SUCCESSFULLY, ACCURATELY OR SECURELY TRANSMITTED.
No Liability
TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, IN NO EVENT SHALL JACKSONS FOOD STORES OR ITS AGENTS OR ANYONE INVOLVED IN CREATING OR PROVIDING THIS APPLICATION OR CONTENT (A) BE LIABLE TO THE USER WITH RESPECT TO USE OF THE APPLICATION; AND/OR (B) BE LIABLE TO THE USER FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY OR OTHER DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, LOST PROFITS, LOSS, THEFT OR CORRUPTION OF USER INFORMATION, THE INABILITY TO USE THE APPLICATION, OR DEVICE FAILURE OR MALFUNCTION. THE USER'S SOLE REMEDY IS TO CEASE USE OF THE APPLICATION. JACKSONS FOOD STORES, ITS AGENTS AND ANYONE INVOLVED IN CREATING OR PROVIDING THIS APPLICATION OR CONTENT SHALL NOT BE LIABLE EVEN IF ANY OF THEM OR ANY AUTHORIZED REPRESENTATIVE OF THEM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES OR INJURY CAUSED BY ERROR, OMISSION, INTERRUPTION, DEFECT, FAILURE OF PERFORMANCE, UNAUTHORIZED USE, DELAY IN OPERATION OR TRANSMISSION, LINE FAILURE, COMPUTER VIRUS, WORM, TROJAN HORSE OR OTHER HARM.
In the event that applicable law does not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental, consequential, or other damages, in no event shall Jacksons Food Stores, its agents or anyone involved in creating or providing this Application or Content be liable for damages, losses, and/or causes of action exceeding the amount, if any, paid by User for use of the Application or $100, whichever is less.
Intellectual Property
Jacksons, Jacksons Rewards Stars, Jacksons Let’s Go Rewards, the Jacksons Punch Cards, Jacksons Let’s Go Rewards logo, and other Jacksons Food Stores trademarks, service marks, graphics and logos used in connection with the Application are trademarks or registered trademarks of Jacksons Food Stores or other companies of Jacksons Let’s Go Rewards (collectively "Jacksons Marks"). Other trademarks, service marks, graphics and logos used in connection with the Application are the trademarks of their respective owners (collectively "Third-Party Marks"). The Jacksons Marks and Third-Party Marks may not be copied, imitated or used, in whole or in part, without the prior written permission of Jacksons Food Stores or the applicable trademark holder. The Application and the Content are protected by copyright, trademark, patent, trade secret, international treaties, laws and other proprietary rights, and also may have security components that protect digital information only as authorized by Jacksons Food Stores or the owner of the Content.
Choice of Law, Jurisdiction
These Terms are governed by the laws of the State of Idaho, United States of America, without regard to Idaho's conflict of laws rules. The User irrevocably consents to the exclusive jurisdiction of the state and federal courts located in Ada County, Idaho, United States of America for purposes of any legal action arising out of or related to the use of the Application or these Terms.
Severability
If any of these Terms shall be deemed invalid, void, or for any reason unenforceable, those terms shall be deemed severable and shall not affect the validity and enforceability of any remaining terms. Failure of Jacksons Food Stores to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision in that or any other instance.
Modification of These Terms
Jacksons Food Stores reserves the right to change or modify these Terms or any other Jacksons Food Stores terms, conditions, or policies related to use of the Application (including those identified in this agreement) at any time and at its sole discretion by posting revisions on the Jacksons Food Stores website (http://www.jacksons.com) or within this Application. Continued use of the Application following the posting of these changes or modifications will constitute the User's acknowledgement and agreement to such changes or modifications. Only a specific, written waiver signed by an authorized representative of Jacksons Food Stores shall have any legal effect as a waiver by Jacksons Food Stores of any Terms of this Agreement.
Third Party Beneficiary
User agrees that Jacksons Food Stores service providers, licensors, or others involved in creating or providing the Application are third party beneficiaries to this End-User Agreement and may rely upon the provisions of this End-User Agreement, including but not limited to, the provisions concerning Indemnification, No Warranties, and No Liability.
Use of Mobile Information
By entering your mobile phone number and opting in,you agree to receive Jacksons Let’s Go Rewards alerts and mobile offers. U.S. mobile numbers only. Message and data rates may apply. Reply HELP to receive HELP or Reply STOP to Opt-Out.
By entering your email address, and opting in, you agree to receive Let’s Go Rewards email messages. Message and data rates may apply. To unsubscribe, click the unsubscribe link.
By opting into ‘App Notifications’ inside of the member profile, you agree to receive Let’s Go Rewards push messages. To opt out, you may adjust your choice from the member profile settings at any time.

Customer Information is information obtained by Jacksons Food Stores in connection with providing a product or service for personal, family or household purposes. We will collect and use sales information or purchase data to determine purchasing trends and locations, calculate available benefits, and deliver appropriate rewards and communications. This will help optimize your customer experience and enhance time spent at participating Jacksons Food Stores locations. Because this information is linked to an individual, it is protected by this policy.

Jacksons Food Stores will not disclose to any company, person, or agency Customer Identifiable Information, such as your name, home or email addresses, or phone numbers, except as described below. We may provide Customer Identifiable Information to service providers that work for us, such as sending a direct mail offer from us to you. However, we require these companies to sign a confidentiality agreement that prohibits them from using your personal information for any unauthorized purposes.

How Can I Prevent My Customer Identifiable Information from Being Disclosed?
You have the right at any time to direct us not to disclose Customer Identifiable Information about you, or to change your preference in this regard, or to change Customer Identifiable Information that you have provided to us, by contacting us by calling Jacksons Let’s Go Rewards customer service toll-free at LetsGoRewards@Jacksons.com. Suppose you direct us not to disclose such information about you. In that case, you will not be eligible for any program-based promotions that require individual data, such as continuities that require Customer Identifiable Information, sweepstakes, etc. However, you will still be entitled to receive other benefits from the use of your Jacksons Let’s Go Rewards account.
Security
Protecting Customer Identifiable Information is an important priority for Jacksons Food Stores. Our internal employee Code of Ethics and this Privacy Policy emphasize this priority. Jacksons Food Store employees who violate our policies and procedures are subject to disciplinary action. Marketing services providers or affiliates that receive Customer Identifiable Information are required to preserve the confidentiality of that information under the terms of our legal contracts with them. Jacksons Food Stores also maintains physical, electronic and procedural safeguards in accordance with industry standards that are designed to keep unauthorized persons from accessing Customer Identifiable Information stored on our systems.

Welcome to the Jacksons Let's Go Rewards Program, owned and operated by Jacksons Food Stores ("Jacksons" or "Jacksons Let's Go Rewards Program"). The Jacksons Let's Go Rewards program terms and conditions form the agreement (the "Agreement") between you ("You") and Jacksons and its locations. This Agreement includes any usage of the Jacksons Food Stores website. PLEASE READ THESE TERMS CAREFULLY AS YOUR USE OF THE JACKSONS LET'S GO REWARDS PROGRAM AND ITS ASSOCIATED WEBSITE CONSTITUTES ACCEPTANCE OF THESE TERMS AND CONDITIONS, AS THEY MAY BE AMENDED AT ANY TIME.
All benefits that are offered in the Jacksons Let's Go Rewards Program are conditioned upon your compliance with these Membership Rules and Conditions. Similarly, the terms of the Revised Privacy Policy are part of these Rules. These Rules are subject to change at any time. Unless otherwise stated, the current Rules in effect at the time that you earn rewards, request a benefit, or any other transaction will govern that transaction.

- Agreement to Terms. YOU AGREE TO READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING The Jacksons Let's Go Rewards program. If you do not agree to these terms and conditions, you may not participate in the Jacksons Let's Go Rewards program. Use of the Jacksons Let's Go Rewards program signifies your agreement to the terms and conditions of use set forth below.
- Modification of Agreement. Jacksons reserves the right, at its sole discretion, to change, modify, add or remove any portion of this Agreement, in whole or in part, at any time. Notification of changes in the Agreement will be posted on www.jacksons.com or at Participating Jacksons Food Stores Locations. Use of the Jacksons Let's Go Rewards program after such notice will be considered your agreement to be bound by any such changes. Please check back frequently for program updates or rule changes.
- Copyright Protection and Use of Company Information. The Jacksons Let's Go Rewards program is protected by copyright as a collective work and/or compilation, pursuant to U.S. copyright laws, international conventions and other copyright laws. Company names, logos and trademarks may not be used by you in any manner without the prior written consent of Company. You should assume, unless specifically noted, that everything you see on the Jacksons website, and any files or programming related to the website and the Jacksons Let's Go Rewards Program, are protected by such rights owned exclusively by Jacksons Food Stores. You may not copy, distribute, publicly display, modify, transmit, reuse, repost, or use for public or commercial purposes, any of the contents of the website without the express written permission of Jacksons, obtained in advance of such use. Permission requests should be sent to: Jacksons Marketing, 3450 E. Commercial Court, Meridian, ID 83642.
- Minimum Age Requirement. Individuals aged 13 and up may participate in Jacksons Let's Go Rewards program, but you must be at least 18 years old or older to participate in any contest or promotions.
- Company's Rights in Jacksons Let's Go Rewards Program. Jacksons and Participating Locations, may change, suspend or discontinue any aspect of the Jacksons Let's Go Rewards program at any time, including but not limited to rewards and point accrual/redemption methods. Jacksons may also impose limits on certain features and services or restrict your access to parts or the entirety of the Jacksons Let's Go Rewards program or the Website without notice or liability. Jacksons reserves the right, in its sole discretion, to refuse service, cancel membership, suspend or terminate an account.
- Indemnification for Your Breach of Agreement. You hereby agree to indemnify, defend and hold Jacksons, and all its officers, directors, owners, agents, employees, information providers, licensors and licensees (collectively, the "Indemnified Parties"), and participating locations harmless from and against any and all liabilities and costs incurred by the Indemnified Parties in connection with any claim arising out of any breach by You of the Agreement or the foregoing representations, warranties and covenants, including, without limitation, attorneys fees and costs. You shall cooperate as fully as reasonably required in the defense of any claim. Jacksons reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by You and You shall not in any event settle any matter without the written consent of Company.

Account Deletion and Stars (Point) Expiration - Under the Jacksons Let's Go Rewards expiration policy, Stars will expire if there has been no account activity for a period of 90 days. If a member's account remains inactive for 90 consecutive days, all accumulated Stars will be wiped to zero, and the account balance will reset. However, as long as the account remains active with ongoing activity, Stars will never expire, allowing members to continue enjoying the rewards they've earned. Jacksons reserves the right to deactivate or close an account under the following circumstances:
- Fraudulent activity occurs
- A member requests an account closure
- A member is deceased
- A member does not respond to repeated communication attempts regarding the status of his/her account
- Audit - Jacksons reserves the right to audit members' accounts at any time and without notice to ensure compliance with the Jacksons Let's Go Rewards program rules and all other applicable Participating Jacksons Location rules and regulations In the event the audit reveals discrepancies or violations, Jacksons may delay the processing of Stars Issuance, Stars redemptions, and withhold statements until the discrepancies or violations are resolved. During an investigation, Jacksons may inhibit the Jacksons Let's Go Rewards account of a member. While the account is inhibited, the member may continue to accrue stars in the account, but no stars redemptions will be permitted. Jacksons Let's Go Rewards membership card must be surrendered to Jacksons or any Participating Jacksons Location upon request.
- Conditions of Enrollment - The Jacksons Let's Go Rewards program is open to any person in any country that is not prohibited from participation in rewards programs. Corporations and/or entities can be enrolled as members, but any Participating Jacksons Location may opt not to issue rewards. Members must provide fully verifiable name, email and phone number to redeem Stars in the Jacksons Let's Go Rewards program. Full name means the given name, and family or surname. The email address and phone number provided must be unique and identifiable to the account holder. Each email and phone number can only be associated with a single account and cannot be reused for multiple accounts. This ensures the security and integrity of your account and the accuracy of communication. Customer Name and Address Notification - Each member shall be responsible for advising Jacksons Food Stores of any change of name, email, telephone number or postal address on their account (if provided).
Name Changes - To update the name on your account, simply log into your member account and navigate to the profile settings, where you can make the necessary changes. Alternatively, if you prefer assistance, you can email Jacksons Guest Service at LetsGoRewards@Jacksons.com for support with updating your name.
Phone number changes- To update the phone number associated with your account, please note that this cannot be done through the account settings inside the member profile. For security reasons, phone number changes must be requested by contacting Jacksons Guest Service. You can do so by emailing LetsGoRewards@Jacksons.com for assistance with updating your phone number.
Address Change - To update your address, log into your member account and go to the account settings in your profile, where you can update your information. Please ensure that the address matches the one on your driver's license or other government-issued ID to ensure proper age and identity verification, particularly if you opt-in to receive 21+ offers on tobacco products. Maintaining accurate address information is essential for eligibility to receive these age-restricted offers. - Your Use of Website - Your access to and use of the Jacksons Let's Go Rewards website, including your account information, are at your risk. This Application may share User’s personal information with or enable you to share your information directly with, LexisNexis to use that service to permit you to view offers make such age restricted purchases using the Application. LexisNexis explains the process you are required to follow to obtain such age verification.
