Terms and Conditions
Welcome to the Jacksons Let's Go Rewards Program, owned and operated by Jacksons Food Stores (Program”, "Jacksons" or "Jacksons Let's Go Rewards Program"). The Jacksons Let's Go Rewards program terms and conditions form the agreement (the "Agreement") between you ("You") and Jacksons and its locations. This Agreement includes any usage of the Jacksons Food Stores website. THESE TERMS CONSTITUTE A BINDING AGREEMENT, GOVERNING USE OF THE PROGRAM, BETWEEN USER AND JACKSONS FOOD STORES, INCLUDING ITS SUBSIDIARY, RELATED, AND AFFILIATED COMPANIES. BY DOWNLOADING, INSTALLING, OR USING THE PROGRAM, USER ACKNOWLEDGES AND AGREES TO BE BOUND BY THESE TERMS. SHOULD USER NOT ACKNOWLEDGE AND AGREE TO THESE TERMS, USER MUST IMMEDIATELY UNINSTALL THIS PROGRAM AND DISCONTINUE ITS USE. THESE TERMS ARE ALSO AVAILABLE ON THE JACKSONS FOOD STORES WEBSITE ( HTTP://WWW.JACKSONS.COM ) AND IN THE PROGRAM'S TERMS SCREEN. CONTINUED USE OF THE PROGRAM SIGNIFIES YOUR CONTINUED ACCEPTANCE OF THESE TERMS AND ANY CHANGES TO THEM.
PLEASE READ THESE TERMS CAREFULLY AS YOUR USE OF THE JACKSONS LET'S GO REWARDS PROGRAM AND ITS ASSOCIATED WEBSITE CONSTITUTES ACCEPTANCE OF THESE TERMS AND CONDITIONS, AS THEY MAY BE AMENDED AT ANY TIME.
Incorporation of Related Terms
These Terms incorporate and supplement the Apple, Inc. ("Apple") and incorporate and supplement Google ("Android) Terms and Conditions (available at http://www.apple.com/legal/itunes/us/terms.html#service ) and Android Terms and Conditions (available at https://www.android.com/enterprise/terms/ ) including without limitation the Licensed Application End User Agreement therein ("Apple Terms" and "Google Terms"). These Terms also incorporate, and supplement other terms, conditions, and policies of Jacksons Food Stores posted at http://www.jacksons.com/terms-of-use , including without limitation the following related terms, conditions, and other policies, the location, and terms of which may be changed from time-to-time.

Should any provisions in the terms, conditions, or other policies listed above conflict with these Terms, these Terms will control, solely to the extent such provisions apply to the Program.
Age Restriction
Only individuals thirteen (13) years of age or older may use the Program. Users between the ages of thirteen (13) and eighteen (18) must review these Terms with a parent or legal guardian to ensure the parent or legal guardian acknowledges and agrees to these Terms. Should User's parent or legal guardian not acknowledge and agree to these Terms, User must immediately uninstall this Program and discontinue its use.
End-User License
Subject to these Terms, Jacksons Let’s Go Rewards, grants the User a personal, non-exclusive, non-transferable, limited, and revocable license to use the Program for personal use only on an Android Phone, Android Tablet ("Android Device"), Apple iPhone, iPad, or iPod Touch ("iOS Device") owned or controlled by User as permitted by the Usage Rules contained in the Apple and Google Play Terms and accordance with these Terms ("User License"). Any use of the Program in any other manner, including, without limitation, resale, transfer, modification, or distribution of the Program or text, pictures, music, barcodes, video, data, hyperlinks, displays, and other content associated with the Program ("Content") is prohibited. This Agreement and User License also govern any updates to, or supplements or replacements for, this Program unless separate terms accompany such updates, supplements, or replacements, in which case the separate terms will apply.
JACKSONS LET'S GO REWARDS Virtual Card Feature
By using the Program's Virtual Card features, the User agrees to the Jacksons Let’s Go Rewards Card Terms and Conditions, Terms of Use and Privacy Policy (available at https://www.jacksons.com ) JACKSONS FOOD STORES reserves the right to change such terms and conditions and privacy policy, and/or discontinue the Program's JACKSONS LET'S GO REWARDS features at any time and without notice to User.
There is no fee to join or participate in the Program, which is only open to You are only allowed one Program account that is personal to you, and you are prohibited from using another account holder or participant's Program points or redemptions without their consent.

1. JACKSONS DIGITAL PUNCH CARDS
a. Eligibility: The digital punch card program is open to eligible users who participate in the program through our app or designated platform.
b. Earning Punch Card Rewards: Punches are earned through qualifying purchases as outlined in the program details. Upon completing the required punches, users will receive a free reward (“freebie”).
c. Reward Expiration: Freebies earned through the digital punch card program must be redeemed within 30 days from the date they are earned. Unredeemed freebies will expire and cannot be reissued.
d. Redemption: Freebies are non-transferable, cannot be exchanged for cash, and must be redeemed in accordance with the program’s specified terms.
e. Program Changes: We reserve the right to modify or discontinue the digital punch card program at any time without prior notice.
By participating in the program, you agree to these Terms & Conditions.

2. EARNING LET’S GO REWARDS STARS
Program members are eligible to earn Stars as follows, subject to the terms set forth in this Agreement and as amended from time-to-time:
a. Merchandise: 10 Stars for every full $1 actually spent on eligible/qualifying items purchased at participating Jacksons Food Stores and ExtraMile by Jacksons stores.
b. Other: Jacksons may also offer special promotions or other offerings which can earn Stars or may otherwise provide Stars for certain occasions or customer service reasons, all at the sole discretion of Jacksons.

For a list of items excluded from the Program, on which you do not earn Stars, and to which you cannot apply rewards, see below in Section 4.
If you make a purchase with, or using, any loyalty, rewards or related program other than Jacksons Let’s Go Rewards, no Stars will be earned for that purchase or transaction. Also, if you make a fuel purchase using your Jacksons Let’s Go Rewards fuel discount (employee only), no Stars will be earned for that transaction.
To earn Stars, a minimum qualifying purchase of $1 of merchandise is required. Additional Stars can be earned for partial dollars spent, rounding up for anything $0.49-$0.99 (for example, a qualifying merchandise purchase of $1.50 earns 20 Stars). Individual transactions cannot be combined. Amounts spent on sales tax, other taxes, tips, delivery fees, donations, activation fees, service charges and related costs do not earn Stars, and Stars are earned on the final amount spent on an individual transaction, excluding these costs, after discounts, coupons, or other promotions are applied.
In order for points to be credited to your Program account balance, you must do the following, or no points will be earned or credited (and points will not be retroactively awarded if you fail or forget to do so for a transaction):
In-Store: For in-store purchases, enter your phone number associated with your Jacksons account when prompted on the pin-pad or provide it to the cashier, or, allow the cashier to scan the Jacksons Let’s Go Rewards barcode as it appears on your mobile device.
Although Stars should be credited to your Program account promptly after the transaction is complete, it is possible there may be some delay for the Stars to appear and be available for redemption.
Except as otherwise set forth herein, Stars that you earn are not lost or forfeited until they are redeemed and the applicable time for non-use has passed (see Section 4 below for further details), you have no Let’s Go Rewards activity for ninety days, or your Jacksons account is cancelled or terminated.
If you void or cancel an eligible transaction credited toward accumulation of Stars, Jacksons reserves the right to deduct the Stars associated with that purchase from your account at any time.
If you make a purchase with, or using, any loyalty, rewards or related program other than Jacksons Let’s Go Rewards, no Stars will be earned for that purchase or transaction. Also, if you make a fuel purchase using your Jacksons Let’s Go Rewards fuel discount (employee only), no Stars will be earned for that transaction.

3. REDEEMING AND USING LET’S GO REWARDS STARS
a. Rewards Catalog: In order to use your available Jacksons Let’s Go Rewards Stars, you must first “clip” the reward you would like to exchange your Stars for from the rewards catalog. Stars may be redeemed in multiples of 100 points, with a minimum of 200 Stars for each redemption.
b. Other: Jacksons may also offer special promotions or other offerings in which Stars can be redeemed at different rates, or for different discounts, than set forth above, all at the sole discretion of Jacksons.

After you redeem your Stars, the applicable rewards balance will appear in your Program account until they are used or they expire.

4. EXCLUSIONS
The following items and services are not eligible to earn or redeem Jacksons Let’s Go Rewards Stars, and Stars cannot be applied against the following items: age-restricted products including but not limited to alcohol, tobacco and nicotine products, lottery, lotto and video poker; financial cards/products including but not limited to money orders, gift cards, reloadable/prepaid cards, phone cards, Pay Near Me income; applicable taxes and fees including but not limited to sales tax, bottle deposits, delivery fees and tips/gratuities; postage stamps; donations; shipping services; any purchases made at a franchise or leased location, even if inside a Jacksons Food Store or ExtraMile by Jacksons facility, which may include Subway, A&W and other brands; mobile contracts; newspapers or magazines; car washes; video centers; breakage fees; certain purchases at truck stop locations (including but not limited to showers, laundromat, scales, cash advances, RV dumps and dry cleaning services); or, any other item prohibited by applicable law. These exclusions are subject to change at Jacksons sole discretion.
From time to time, Jacksons may run promotions that include certain of these items (for example, it may award a certain number of Stars for a gift card purchase in connection with a particular promotional event).Those limited offers are not valid unless and until communicated by Jacksons for that specific purpose.
5. EXPIRATION OF REWARDS/STARS/REDEMPTIONS/DISCOUNTS
Stars that you have earned will not expire or be lost/forfeited unless:
a. They are redeemed and the applicable time for non-use/expiration has passed;
b. You have no Jacksons Rewards activity for ninety days, in which case all of your Stars, redemptions and balances will expire; or
c. Your Jacksons account is cancelled or terminated, in which case all of your Stars, redemptions and balances will expire (creating a new Jacksons account or reactivating a prior account will not restore Stars/balances).
You acknowledge that Jacksons has no liability to you for failure to redeem Stars, use your rewards or if your Stars or redemptions otherwise expire or are lost for any reason.

b. You have no Jacksons Rewards activity for ninety days, in which case all of your Stars, redemptions and balances will expire; or
c. Your Jacksons account is cancelled or terminated, in which case all of your Stars, redemptions and balances will expire (creating a new Jacksons account or reactivating a prior account will not restore Stars/balances).
You acknowledge that Jacksons has no liability to you for failure to redeem Stars, use your rewards or if your Stars or redemptions otherwise expire or are lost for any reason.
6. MODIFICATION OR TERMINATION OF THIS AGREEMENT OR THE PROGRAM
Jacksons may change, suspend, discontinue or cancel any aspect of the Program or your Jacksons Let’s Go Rewards account or balance at any time, including but not limited to rewards and Stars earning/redemption/usage methods, at its sole discretion and without notice to you. In addition, Jacksons may convert the Program and Stars/redemptions into different rewards programs having different Star values at any time without notice. This means that the number of Stars needed to redeem a reward, or a certain level or reward, may be increased, the time for earning or using them reduced, or the rewards changed, so you may not be able to obtain, earn or claim certain rewards no matter how long you participate in the Program. This includes reserving the right to apply changes retroactively to benefits already earned under the program.
Jacksons may also impose limits on membership eligibility, certain features and services or restrict your access to parts or all of the Program, without notice or liability. Jacksons reserves the right, in its sole discretion, to refuse service or suspend or terminate a Jacksons account or participation in the Program.
Although Jacksons will make reasonable efforts to notify participants of any changes, you should periodically check the Terms and Conditions of Use for applicable changes.
7. INACCURACIES OR ERRORS
The descriptions, pictures, representations of products, promotions and/or other information available through the Program may contain inaccuracies and/or errors. Jacksons does not make any warranty or representation with respect to the accuracy or completeness of any such information and reserves the right to correct the same without penalty. Furthermore, the prices and availability of products referenced through the Program may change without notice to you at any time and at Jacksons sole discretion. Jacksons shall have the right to refuse or cancel any advertisements placed or listed at an incorrect price or location.
8. USER INFORMATION
Program features, such as Virtual Jacksons Let’s Go Rewards program, store locator, mobile gifting, feedback, account management, and interaction with social media sites, may use, maintain, or transmit User's personal information, including, without limitation, user names, passwords, proper names, email address, address, location, financial information (including credit card information), virtual Jacksons Let’s Go Rewards card information, GPS location information, and information for and from third-party social-media accounts (collectively "User Information"). By acknowledging and agreeing to this Agreement, or by using the Program, User consents to the transmission of User Information to Jacksons Food Stores, including its agents and third-party partners, and consents to Jacksons Let’s Go Rewards Coalition, including its agents and third-party partners, receiving, collecting, storing, processing, transmitting, and using User Information for Program functionality and for the purposes disclosed in one or more of the Jacksons Food Stores Privacy Policies identified in this Agreement.
The User is, however, solely responsible for the confidentiality and security of User Information sent from or stored on the iOS Device by the Program. The User is also solely responsible for all transactions and activities undertaken by anyone or anything with any Jacksons Let’s Go Rewards card registered in the User's name, whether authorized or unauthorized. This includes any and all unauthorized purchases made from the Virtual Jacksons Let’s Go Rewards card feature. The User agrees to immediately notify Jacksons Food Stores of any suspected unauthorized transactions associated with the Program or any other breach of security. Jacksons Food Stores shall not be responsible for any losses arising from the financial loss or theft of User Information due to unauthorized or fraudulent transactions related to the Program. Users shall be solely responsible for taking precautionary steps to protect User Information stored on the iOS Device, including without limitation password-protecting the iOS Device and employing Apple's remote-wipe feature.
9. PROHIBITED USES
Use of the Program is limited to the contemplated functionality. The Program shall not be used in any way that,
- Harasses, abuses, stalks, threatens, defames, or otherwise infringes or violates the rights of any other party (including but not limited to rights of publicity or other proprietary rights);
- is unlawful, fraudulent, or deceptive;
- uses technology or other means to access unauthorized content or non-public spaces;
- uses or launches any automated system or process, including without limitation, "bots," "spiders," or "crawlers," to access unauthorized content or non-public spaces;
- attempts to introduce viruses or any other harmful computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
- attempts to damage, disable, overburden, or impair Jacksons Food Stores servers or networks;
- attempts to gain unauthorized access to a Jacksons Food Stores computer network;
- attempts to gain unauthorized access to Jacksons Food Stores user accounts;
- encourages conduct that would constitute a criminal offense, or that gives rise to civil liability;
- violates these Terms in any manner; or;
- fails to comply with applicable third-party terms and conditions or other third-party policies (collectively "Acceptable Use").
Jacksons Food Stores reserves the right, in its sole discretion, to terminate any User License, remove Content, assist law enforcement in the prosecution of criminal liability, or assert a civil or criminal legal action with respect to Content or use of the Program, including any Virtual Jacksons Let’s Go Rewards Card, that Jacksons Food Stores reasonably believes is or might be in violation of these Terms, but failure or delay in taking such actions does not constitute a waiver of its rights to enforce these Terms.
10. USER-GENERATED CONTENT
The User may generate content, written or otherwise, while using the Program ("User-Generated Content"). User acknowledges and agrees that User-Generated Content may be used, reproduced, displayed, modified, deleted, added to, adapted, and published by Jacksons Food Stores (i.e., in product marketing campaigns). User grants Jacksons Food Stores and its successors a worldwide; irrevocable; transferable; sublicensable; fully-paid and royalty-free; non-exclusive license to use, reproduce, display, modify, delete from, add to, adapt, publish, and prepare derivative works from the User-Generated Information. User further acknowledges and agrees that the User, and the User alone, is responsible for the development of User-Generated Content.
11. INDEMNIFICATION
User agrees to indemnify and hold harmless Jacksons Food Stores, including its agents, affiliated companies, employees, contractors, directors, and officers, and anyone involved in creating or providing the Program, from all claims or causes of action, liabilities, damages, costs, fines, penalties, and expenses (including attorneys' fees) occurring from or related to the use or misuse of the Program, violation of these Terms, or violations of any rights of a third party, or any allegation thereof. Jacksons Food Stores reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by the User, in which event the User will cooperate in asserting any available defenses.
12. NO WARRANTIES
JACKSONS FOOD STORES IS PROVIDING THE PROGRAM AND CONTENT TO THE USER "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OR REPRESENTATIONS, EXPRESSED OR IMPLIED. THE USER IS USING THE PROGRAM AT HIS OR HER OWN RISK. TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, JACKSONS FOOD STORES DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES THAT THE PROGRAM IS MERCHANTABLE, RELIABLE, ACCURATE, FIT FOR A PARTICULAR PURPOSE OR NEED, NON-INFRINGING OR FREE OF DEFECTS OR ABLE TO OPERATE ON AN UNINTERRUPTED BASIS, OR THAT THE USE OF THE PROGRAM BY THE USER IS IN COMPLIANCE WITH LAWS, OR THAT USER INFORMATION TRANSMITTED IN CONNECTION WITH THE PROGRAM WILL BE SUCCESSFULLY, ACCURATELY OR SECURELY TRANSMITTED.
13. NO LIABILITY
TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, IN NO EVENT SHALL JACKSONS FOOD STORES OR ITS AGENTS OR ANYONE INVOLVED IN CREATING OR PROVIDING THIS PROGRAM OR CONTENT (A) BE LIABLE TO THE USER WITH RESPECT TO USE OF THE PROGRAM; AND/OR (B) BE LIABLE TO THE USER FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY OR OTHER DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, LOST PROFITS, LOSS, THEFT OR CORRUPTION OF USER INFORMATION, THE INABILITY TO USE THE PROGRAM, OR DEVICE FAILURE OR MALFUNCTION. THE USER'S SOLE REMEDY IS TO CEASE USE OF THE PROGRAM. JACKSONS FOOD STORES, ITS AGENTS AND ANYONE INVOLVED IN CREATING OR PROVIDING THIS PROGRAM OR CONTENT SHALL NOT BE LIABLE EVEN IF ANY OF THEM OR ANY AUTHORIZED REPRESENTATIVE OF THEM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES OR INJURY CAUSED BY ERROR, OMISSION, INTERRUPTION, DEFECT, FAILURE OF PERFORMANCE, UNAUTHORIZED USE, DELAY IN OPERATION OR TRANSMISSION, LINE FAILURE, COMPUTER VIRUS, WORM, TROJAN HORSE OR OTHER HARM.
In the event that applicable law does not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental, consequential, or other damages, in no event shall Jacksons Food Stores, its agents or anyone involved in creating or providing this Program or Content be liable for damages, losses, and/or causes of action exceeding the amount, if any, paid by User for use of the Program or $100, whichever is less.
14. INTELLECTUAL PROPERTY
Jacksons, Jacksons Rewards Stars, Jacksons Let’s Go Rewards, the Jacksons Punch Cards, Jacksons Let’s Go Rewards logo, and other Jacksons Food Stores trademarks, service marks, graphics and logos used in connection with the Program are trademarks or registered trademarks of Jacksons Food Stores or other companies of Jacksons Let’s Go Rewards (collectively "Jacksons Marks"). Other trademarks, service marks, graphics and logos used in connection with the Program are the trademarks of their respective owners (collectively "Third-Party Marks"). The Jacksons Marks and Third-Party Marks may not be copied, imitated or used, in whole or in part, without the prior written permission of Jacksons Food Stores or the applicable trademark holder. 15. CHOICE OF LAW, JURISDICTION
These Terms are governed by the laws of the State of Idaho, United States of America, without regard to Idaho's conflict of laws rules. The User irrevocably consents to the exclusive jurisdiction of the state and federal courts located in Ada County, Idaho, United States of America for purposes of any legal action arising out of or related to the use of the Program or these Terms.
16. SEVERABILITY
If any of these Terms shall be deemed invalid, void, or for any reason unenforceable, those terms shall be deemed severable and shall not affect the validity and enforceability of any remaining terms. Failure of Jacksons Food Stores to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision in that or any other instance.
17. MODIFICATION OF THESE TERMS
Jacksons Food Stores reserves the right to change or modify these Terms or any other Jacksons Food Stores terms, conditions, or policies related to use of the Program (including those identified in this agreement) at any time and at its sole discretion by posting revisions on the Jacksons Food Stores website ( http://www.jacksons.com ) or within this Program. Continued use of the Program following the posting of these changes or modifications will constitute the User's acknowledgement and agreement to such changes or modifications. Only a specific, written waiver signed by an authorized representative of Jacksons Food Stores shall have any legal effect as a waiver by Jacksons Food Stores of any Terms of this Agreement.
18. THIRD PARTY BENEFICIARY
User agrees that Jacksons Food Stores service providers, licensors, or others involved in creating or providing the Program are third party beneficiaries to this End-User Agreement and may rely upon the provisions of this End-User Agreement, including but not limited to, the provisions concerning Indemnification, No Warranties, and No Liability.
